This is a setback. The government wrote a ban. The courts parked it.
On 6 February 2025 President Milei issued DNU 62/2025, substituting Article 11 of Gender Identity Law 26.743 so people under 18 “shall not access” the surgical interventions and comprehensive hormone treatments that article covers. That is a government ban by decree.
On 16 July 2026 Infoleg — the official Argentine legislation site — records that Sala V of the Cámara Contencioso Administrativo Federal ordered a precautionary suspension of Decree 62/2025 until the action is resolved, in incident No. 1, CAF No. 1065/25, Federación Argentina de Lesbianas, Gays, Bisexuales y Trans y otros c/ PEN — DNU 62/25.
The decree happened. It is not in force today. While that stay sits on the official page, Argentina is not a clean national ban.
