Ley 5/2025, de 30 de mayo, of the Generalitat, amended Ley 8/2017 (integral recognition of gender identity and expression in the Valencian Community). Artículo 136 rewrote Artículo 16 (health care of minors). The rewritten text still describes a pathway to puberty blockers and opposite-sex hormones. It added gates: child-and-adolescent mental-health accompaniment for the whole pharmacological process; a favourable comorbidity report where needed; and authorisation by those with legal custody or by a judge. That is a regional tightening.
The President of the Government lodged recurso de inconstitucionalidad n.º 1549-2026. The Tribunal Constitucional providencia of 28 April 2026 (published 6 May 2026, BOE-A-2026-9794) admitted the challenge and, because Article 161.2 of the Constitution was invoked, suspended the challenged precepts — including the cited incisos of Ley 8/2017 Articles 6, 8, 16, 23.2 and 24 as rewritten by Ley 5/2025 Articles 127, 129, 136, 139 and 140. Auto 45/2026 of 7 July (BOE-A-2026-16931) maintained those suspensions (and lifted a separate public-function precept). The regional statute exists. Spain’s Constitutional Court has paused enforcement. Education rules in the same case were also paused.
