India’s Transgender Persons (Protection of Rights) Amendment Act, 2026 is an identity law.
The official Gazette Act (CG-DL-E-31032026-271438; Act No. 3 of 2026) amends the 2019 Act. It:
- Redefines “transgender person” around named socio-cultural identities and disorders of sex development (DSD), and includes a person or child compelled by force, allurement, or deceit to present a transgender identity after mutilation, castration, or a surgical, chemical, or hormonal procedure. Self-perceived sexual identity is excluded. - Creates an “authority” — a medical board headed by a CMO or Deputy CMO — whose recommendation the District Magistrate examines before issuing a certificate of identity. - Substitutes section 18 with offences for kidnapping, forced identity, and bodily harm, including forced surgical, chemical, or hormonal procedures on adults and children.
Those are identity-paper and forced-procedure offences.
